Avv. Prof. Francesco Mucciarelli
Born in 1952, he enrolled in the special register of trainee lawyers in 1976 and then qualified to plead in the higher courts; he has always worked at the law firm set up by Avv. Antonio Mucciarelli and Professor Cesare Pedrazzi. He practices the legal profession essentially in the area of economic criminal law. He has had the opportunity to engage – on behalf of the Firm – in several legal cases (including particularly significant ones) in matters related to bankruptcy, tax, banking, corporate, protection of financial markets and offences against the public administration, as well as in the areas of environmental protection, industrial accidents and negligent disasters. He provides extensive out-of-court assistance and advice, especially in banking and corporate issues and in relation to protection of markets. He permanently advises the supervisory boards set up pursuant to Legislative Decree No. 231/01 of two of the major Italian banking institutions and one of the top national insurance companies.
He holds the chair of criminal law and economic criminal law at the Università Commerciale Luigi Bocconi of Milan, he is reader of economic criminal law at the Scuola superiore di studi universitari e di perfezionamento Sant’Anna (Sant’Anna School for Advanced Studies and Specialization) of Pisa; he teaches postgraduate specialization courses at the Università Statale di Milano (State University of Milan) and Università Cattolica del Sacro Cuore (Catholic University of the Sacred Heart), as well as at the Scuola Superiore della Magistratura (School for Advanced Studies for Judges) for the (national and decentralized) training of judges.
He is the author of over one hundred publications in leading journals (see list) in various areas of economic criminal law (some of which have been taken up by specific judicial stances by the Italian Supreme Court of Cassation: unfair presentation of financial statements, bankruptcy offences, culpable liability) and in some domains related to the general principles of criminal law (e.g., causation and criteria for ascribing subjective liability for a misconduct, such as negligence, intent, error and awareness of unlawfulness).
